The Delhi High Court on Thursday refused to grant interim relief to Trimurti Films in a copyright dispute between Trimurti Films and the producers of the film ‘Dhurandhar 2’. The case is related to the song ‘Tirchi Topiwale (Oye Oye)’. Trimurti Films had sought to stop the OTT release of ‘Dhurandhar 2’, which the court refused to stop.
However, Justice Tushar Rao Gedela directed Super Cassettes to deposit ₹50 lakh in court within four weeks.
The complainant in the case is Trimurti Films (Rajiv Rai) and the respondents include Super Cassettes (T-Series) and B62 Studios.Super Cassettes Industries Private Limited is known worldwide as T-Series.
All audio and music rights for the film ‘Dhurandhar 2’ are with Super Cassettes (T-Series).
The court said that it is not possible to issue an interim order as per the plaintiff’s demand at this time, but it would be appropriate to demand a deposit to secure Trimurti Films’ claim.
According to a Bar & Bench report, the court directed that this amount be deposited in the name of the Registrar General and kept in auto-renewal. The successful party will benefit from it at the end of the trial. A detailed copy of the order has not yet been released.
What is the whole matter?
Production company Trimurti Films had filed a copyright infringement case against filmmaker Aditya Dhar’s production house B62 Studios.
The company alleged that the song ‘Rang De Lal (Oye Oye)’ from the film ‘Dhurandhar 2’ used the famous song ‘Tirchhi Topiwale (Oye Oye)’ from the 1989 film ‘Tridev’ and a similar tune without permission.
Trimurti Films was founded in 1969 by producer Gulshan Rai. Currently, its owner is Gulshan Rai’s son and filmmaker Rajiv Rai.
Trimurti Films claimed that it held the rights to the song and its use without a license constituted copyright infringement. The company also objected to the commercial use of the song in the film’s theatrical release, digital platforms, and promotional content.
‘Tirchi Topiwale’ was primarily filmed on Naseeruddin Shah and Sonam. The music for the song was composed by Kalyanji-Anandji. It was sung by Amit Kumar and Sapna Mukherjee, and its lyrics were written by Anand Bakshi.
Meanwhile, the new version ‘Rang De Laal (Oye Oye)’ has been voiced by Jasmine Sandlas, Afsana Khan, Amit Kumar, and Rebel. Its music has been composed by Shashwat Sachdev, and Kalyanji-Anandji have also been credited in the song.
