TMC’s Abhishek Banerjee approaches Calcutta High Court to quash FIR:Case filed over inflammatory speech during election campaign; hearing possible on May 21

Mamata Banerjee’s nephew and TMC MP Abhishek Banerjee has filed a petition in the Calcutta High Court for quashing an FIR. The allegations against the TMC leader include delivering inflammatory speeches during the Bengal assembly election campaign and making threatening statements against Home Minister Amit Shah.

TMC MP and senior advocate Kalyan Banerjee said that the matter might come up for hearing before the bench of Justice Saugata Bhattacharyya on May 21.

This case was registered on the complaint of social activist Rajib Sarkar. He had filed a complaint at Baguiati Police Station on May 5, a day after the election results were declared. Later, he was referred to the Cyber Crime Branch. Subsequently, an FIR was registered on May 15 at Bidhannagar Cyber Crime Police Station in North 24 Parganas.

  • There is a mention of Abhishek’s election speeches between April 27 and May 3. Video links of these have also been provided to the police.
  • The complainant also referred to Abhishek’s statement at the Kolkata rally on April 7, in which he said, “On May 4, I will see who comes to save them, which godfather comes from Delhi to save them.”
  • A case has been registered against Abhishek under BNS sections 196 (spreading enmity/hatred), 351 (criminal intimidation), 353(1)(c) (spreading misinformation inciting hatred), and other sections. Section 196 is non-bailable, which provides for imprisonment up to 3 years and a fine.

Abhishek Banerjee’s last 4 statements on Shah

April 10, 2026: Abhishek Banarjee, while responding to Shah’s infiltration accusation, had said, “If infiltration is happening, then Amit Shah is responsible for it. Border security is under BSF and the Home Ministry, not the state government.”

April 16, 2026: At a rally in Bhagwanpur, Purba Medinipur, he said, “I challenge Amit Shah, if you have the guts, be in Kolkata on May 4. We will meet after 12 PM. On May 4, it will be known how big a goon you are. You people started the game; the rest will be done by TMC.”

April 25, 2026: During the election campaign, Abhishek said, “Amit Shah is playing politics of intimidating voters. BJP sees defeat, which is why an atmosphere of fear is being created.”

May 2, 2026: He said, “Amit Shah and the Election Commission, both listen, on May 4, the people of Bengal will respond. Every attempt to suppress democracy will be answered.”
